CHARGES DISMISSED for Mechanic Wrongfully Prosecuted for Theft

A Cobb County mechanic was wrongfully prosecuted for theft by taking following a contract dispute with a customer. The police investigated the complaint made by a customer and found insufficient evidence of a crime, but the customer went to Magistrate Court and successfully applied for a private citizen's warrant. This lead to the mechanic's arrest and formal charges filed by the DA. Kilgore & Rodriguez's investigation found that the complainant refused to take possession of the vehicle when given multiple opportunities to reclaim the vehicle and that the mechanic never possessed the vehicle for his own personal use. The mechanic's case was dismissed and criminal arrest record restricted from public access.
