The age of consent in Georgia is 16 years old. This means that any consensual sex between two persons 16 years old or older is legal in Georgia. By contrast, however, any sexual contact with a child under the age of 16, regardless of consent, is a crime prohibited by the child molestation statute. An interesting note about the interplay between the age of consent for sex and the statutes prohibiting the sexual exploitation of children in Georgia… While it is not a crime for two persons 16 years old or older to have consensual sex, it can be a felony for someone “sexting” to possess a nude photo of a 17 year old – even if the 17 year old depicted in the photo knowingly and voluntarily provided the photo to the other.
