Generally and depending on the amount of marijuana involved, someone convicted of growing marijuana in Georgia can receive a prison sentence of one to ten years. However, the Georgia trafficking in marijuana statute prohibits any person who sells, manufactures, grows, delivers, brings into Georgia, or has possession of a quantity of marijuana exceeding ten pounds. The punishment varies depending on if the quantity of marijuana involved is in excess of ten pounds, but less than 2,000 pounds, then the person shall be sentenced to a mandatory minimum prison sentence of five years (and a fine of $100,000.00); if the quantity of marijuana involved is 2,000 pounds or more, but less than 10,000 pounds, then the person shall be sentenced to a mandatory minimum prison sentence of seven years (and a fine of $250,000.00); and if the quantity of marijuana involved is 10,000 pounds or more, then the person shall be sentenced to a mandatory minimum prison sentence of 15 years (and a fine of $1 million).
